Pixel Penguin is a software development studio operating from Swakopmund, Namibia. We design, build, and operate web applications for clients across Southern Africa, and we publish our own subscription products under the Lekker brand.

We currently operate two subscription products:

• Lekker Accounting — a multi-tenant cloud accounting platform for small businesses, providing invoicing, quoting, expense tracking, bank statement imports, reporting, a client portal, and an AI assistant ("LekkerBot") that drafts invoices and processes receipts.
• LekkerFlow — an AI-powered project management platform with Slack-based morning check-ins, ticket management, sprint planning, and natural-language interpretation of progress updates.

Both products are delivered as software-as-a-service ("SaaS") and are subject to the subscription fees set out below.

Lekker Accounting is sold on a per-workspace basis. Each workspace ("tenant") receives an isolated database, its own users, clients, products, invoices, and settings. Subscription fees are charged per workspace, per billing period, and are quoted in Namibian Dollar (NAD / N$). Equivalent pricing in South African Rand (ZAR) and US Dollar (USD) is offered at conversion rates updated monthly.

Annual billing. All plans may be paid annually with a 15% discount (equivalent to 10.2 months at the monthly rate). Annual subscriptions are non-refundable for the unused portion of the period.

Free trial. New workspaces receive a 7-day free trial of the Growth plan. No payment information is required to start the trial. At the end of the trial period the workspace is downgraded to Starter unless a paid subscription is activated.

Plan changes. Upgrades take effect immediately and are pro-rated for the remainder of the current billing period. Downgrades take effect at the start of the next billing period.

LekkerFlow is sold per workspace, with subscription fees calculated on a per-active-user, per-month basis. An "active user" is a workspace member who has signed in at least once during the billing period. Pricing is quoted in Namibian Dollar (NAD / N$).

User counting. The number of active users is calculated at the end of each billing period. Adding a user mid-period adds a pro-rated charge to the next invoice; removing a user does not generate a refund for the current period.

Annual billing. All paid plans may be paid annually with a 15% discount. Annual subscriptions are non-refundable for the unused portion of the period.

Free trial. The Team plan may be trialled free for 14 days for up to 10 users. No payment information is required.

Both Lekker Accounting and LekkerFlow include AI features powered by third-party large language models. Use of these AI features is metered against an AI credit balance attached to your workspace. Each subscription plan includes a monthly credit allocation as set out above.

Unused monthly credits do not roll over to the following billing period. Additional credits may be purchased on demand at the following rates:

Credit pricing includes a markup over the underlying AI provider's API cost to cover infrastructure, support, and operating expenses. The exact credit cost of each AI action is logged against your workspace's transaction history and is visible in your account at any time.

Purchased credit packs are non-refundable but do not expire. If a workspace is cancelled, any purchased credit balance is forfeited.

Subscription fees are billed in advance at the start of each billing period (monthly or annual, as selected by you). Payment is due on the invoice date. Accepted payment methods include credit/debit card, electronic funds transfer (EFT), and direct bank deposit to our FNB business account, the details of which are provided on each invoice.

All fees are quoted exclusive of any applicable Value-Added Tax (VAT) or similar indirect taxes, which will be added to your invoice where required by Namibian or other applicable law.

Late payment. If a subscription invoice remains unpaid for more than seven (7) days after the due date, we reserve the right to suspend access to the affected workspace until payment is received. Workspaces remain in a suspended state for thirty (30) days, after which they may be archived. Archived data is retained for a further sixty (60) days during which the subscription may be reinstated upon settlement of the outstanding balance.

Failed payments. Where automated card billing fails, we will attempt to recover the payment up to three (3) times over a five-day period and notify you by email. Continued failure will result in suspension as set out above.

You may cancel your subscription at any time from within your workspace settings, or by emailing gerrit@pixel-penguin.com. Cancellation takes effect at the end of the current billing period — your workspace remains accessible until that date.

Monthly subscriptions are non-refundable for the current month. Annual subscriptions are non-refundable for the unused portion of the year. AI credit packs are non-refundable.

We may, at our sole discretion, issue a refund or credit in cases of extended service unavailability or material breach of these Terms by us.

We may revise our subscription fees, plan inclusions, or AI credit pricing from time to time. Where any change increases the fee payable by an existing subscriber, we will provide at least thirty (30) days' written notice by email before the change takes effect. You may cancel your subscription at any point during the notice period without penalty.

All data you upload, enter, or generate within the Services ("Customer Data") remains your property. We act as a data processor and use Customer Data only as necessary to provide the Services. We will not sell, rent, or disclose Customer Data to third parties except as required to operate the Services (for example, sending emails, generating PDFs, or processing AI requests through our chosen AI provider).

On request and during an active subscription, you may export your data in standard formats (CSV, PDF, Excel). Following cancellation, your data is retained for a period of ninety (90) days during which export remains available, after which it is permanently deleted from our production systems. Backup copies are retained for a further thirty (30) days for disaster recovery purposes only.

You agree not to use the Services to: (a) violate any applicable law or regulation; (b) infringe the intellectual property rights of any party; (c) transmit malicious code, spam, or fraudulent content; (d) attempt to gain unauthorised access to any other workspace or to our underlying infrastructure; or (e) resell, sublicense, or otherwise commercialise access to the Services without our prior written consent.

To the maximum extent permitted by law, our total liability to you arising out of or in connection with these Terms, the Services, or any subscription is limited to the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data.

The Services are provided on an "as is" and "as available" basis. While we make every reasonable effort to ensure availability and accuracy, we do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

These Terms are governed by and construed in accordance with the laws of the Republic of Namibia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Namibia.

We may amend these Terms from time to time. Material changes will be notified to active subscribers by email at least thirty (30) days before they take effect. Continued use of the Services after the effective date of any change constitutes acceptance of the revised Terms.
